Seller shall be excused from liability for unusual delays or failure to deliver or fill any Purchase order where caused by acts of God, strikes, labor difficulties, fires, floods, accidents, allocation controls, defaults of common carries including shortage of trucks or any other means of transportation, fuels, materials, labor, other cause beyond the seller`s reasonable control or any loss or damage arising there from whether not similar in kind or class to those mentioned." |
